JaxJobs" is a trademark of ComSouth Advertising, Inc and is protected by United States and international laws. The Terms of Service do not authorize you to use "JaxJobs" or any similar or related marks (including, for example and without limitation "JaxJobs") for any use pertaining to recruitment/employment advertising online, in print, electronic media, social networks or any similar or related use, or any other use that is likely to cause confusion on the part of, to cause mistake by or to deceive the public as to any affiliation, connection, association, origin, sponsorship, approval or endorsement by or with JaxJobs or ComSouth Advertising. Any commercial use of JaxJobs content is prohibited without the expressed written permission of JaxJobs.

2. Use License

1. Permission is granted to temporarily download one copy of the materials (information or software) on JaxJobs' website for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:
   1. modify or copy the materials;
   2. use the materials for any commercial purpose, or for any public display (commercial or non-commercial);
   3. attempt to decompile or reverse engineer any software contained on JaxJobs' web site;
   4. remove any copyright or other proprietary notations from the materials; or
   5. transfer the materials to another person or "mirror" the materials on any other server.
2. This license shall automatically terminate if you violate any of these restrictions and may be terminated by JaxJobs at any time. Upon terminating your viewing of these materials or upon the termination of this license, you must destroy any downloaded materials in your possession whether in electronic or printed format.

JaxJobs reserves the right to use the content of messages sent through JaxJobs to prevent potentially illegal activities and activities that are detrimental to other users. JaxJobs reserves the right to use a variety of methods to detect and address suspect activity and screen content to prevent abuse such as spam. These efforts may on occasion result in a temporary or permanent suspension or termination of some functions for some users.

Special License to Use by Employers:  A limited, terminable, non-exclusive right to access and utilize JaxJobs website, including the Materials and Services, is granted to you by JaxJobs only for your internal business use in obtaining applicants for employment. You are authorized to view and download material on JaxJobs only for your personal use related to searching for and recruiting job applicants. The selling, transfer, or assign any of the materials, services or your rights to any of the services provided by JaxJobs to any third is prohibited. You agree that you are exclusively responsible for the content of any document or data you post to the site and any ramification caused from that action. JaxJobs reserves the right to suspend or terminate your access and use at will without refund of any payments received if JaxJobs deems that you are in breach of our Terms of Service and Privacy policies.

All postings for jobs must detail an individual position for 1099 or traditional W-2 employees. Single postings are forbidden advertising multiple job openings. If it discovered: (i) the user misled JaxJobs concerning practices and/or services in regard to your business, or (ii) services were purchased that do not characterize the users exact business, JaxJobs reserves the right to terminate your Agreement without refund.

JaxJobs may grant you a non-exclusive, personal, terminable, limited right to access the JaxJobs resume database via the site for the sole purpose of downloading, printing, and/or viewing a single copy of available resumes for your use. User agrees to utilize the JaxJobs Resume Database strictly for seeking candidates for employment. User is specifically prohibited from using information obtained to take action that can or will hinder with our business or violates the privacy of other users, including, but not limited to promoting or selling products or services.

All right, title and interest in and to the JaxJobs resume database and other services shall remain in JaxJobs JaxJobs, at its discretion may terminate, suspend, alter or purge any or all content in the resume database. At no time does JaxJobs convey any interest in or to the resume database or any other property or service.

3. Registration

To utilize some of JaxJobs services you will be required to register. If you register, you agree to provide true, current, complete, and accurate information within the registration form including your name and email address. Resume postings must contain the accurate resume of a living individual seeking employment on a full-time, part-time, or contractual basis on his or her own behalf. Additionally, you agree to keep the use of your username and password confidential and not transfer or resell your use of or access to the site to any third party.

4. Ownership and Rights to Use Materials

User warrants that all content and materials submitted shall be your original work product and will not be based on, or derived from, the proprietary information or items of a third party. User warrants ownership and rights to any content, images or materials posted to or submitted to JaxJobs.  User also grants JaxJobs a nonexclusive, worldwide, perpetual, irrevocable, royalty-free, sub-licensable (through multiple layers of sublicenses) right and license to make, use, sell, sublicense, reproduce, distribute, perform, display, prepare derivative works from and otherwise exploit all such content and materials for any purpose without restriction. Furthermore, you grant JaxJobs, the right to use your name and/or user name in connection with the content. User also warrants and agrees not to impersonate any person or communicate under a false name or a name you are not entitled or authorized to use. User will defend and indemnify JaxJobs and its affiliates from any claims resulting from any content or materials you provide.

5. User Restrictions

You agree not to access or attempt to access any of the services or site by any means other than through the interface that is provided by JaxJobs. You agree that you will not engage in any activity that interferes with or disrupts the services or site or the servers and networks, which are connected to the services or site.

You agree that you will not reproduce, duplicate, copy, sell, trade or resell the services or site for any purpose. You agree that you are solely responsible for any breach of your obligations under these Terms and Conditions and for the consequences including any loss or damage, which JaxJobs may incur of any such breach.

• User may not post or disseminate unlawful, defamatory, harassing, abusive, fraudulent, infringing, obscene, or otherwise objectionable content
• User may not post informations which may be harmful to minors
• User may not Impersonate another person (via the use of an email address or otherwise) or otherwise misrepresent themselves or the source of any email
• User may not submit or illegally transmit another's intellectual property without the owner's or licensor's written consent
• User may not intentionally distribute viruses, Trojan horses, worms, defects, corrupted files, hoaxes, or any other items of a destructive or deceptive nature
• User may not solicit, offer or promote pyramid schemes and the like
• User may not create multiple user accounts in connection with any violation of the Agreement or create user accounts by automated means or under false or fraudulent pretenses
• User may not modify, adapt, translate, or reverse engineer any portion of the JaxJobs Service
• User may not sell, or otherwise exploit for any unauthorized commercial purpose or transfer JaxJobs account
• User may not utilize JaxJobs to infringe on or violate the legal rights (such as rights of privacy) of others
• User may not encourage illegal activity
• User may not impede or interfere with the rights of other users and their ability to use the site
• User may not create multiple user accounts in connection with any violation of the Agreement or create user accounts by automated means or under false or fraudulent pretenses
• User may not Provide false information in the course of using JaxJobs
• User may not sell, or otherwise exploit for any unauthorized commercial purpose or transfer JaxJobs account
• User may not modify, adapt, translate, or reverse engineer any portion of the JaxJobs Service
• User may not Reformat or frame any portion of the web pages that are part of the JaxJobs website without our explicit permission
• User may not contact other JaxJobs users about any topics JaxJobs considers detrimental to its users including multi-level marketing (MLM) programs and jobs that require payment to start,
• User may not Create multiple JaxJobs accounts without permission
• User may not bypass any suspensions or limitations of functionality
• User may not Remove any copyright, trademark or other proprietary rights notices contained in or on the JaxJobs Site

Any violation of above may result in suspension or termination of services and no refund shall be due.

6. Intellectual Property.

The JaxJobs websites, materials, layout, design, logos, and any other graphical design element including the code that JaxJobs uses to render or display the content or the pages making up the site and all right, title and interest in JaxJobs are the sole property of JaxJobs and ComSouth Advertising, Inc. and are protected by United States copyright, trademark, and other laws. Except for the limited licenses granted to you in these Terms of Service, JaxJobs reserves all other rights, title and interest. You may not recreate, revise, exhibit, sell, or distribute the JaxJobs content or materials or use them in any other way for public or commercial purpose. This includes but is not limited to copying or altering the programming code used to render web pages on JaxJobs. Using any tools, systems automated or manual, processes, devices, robots, or any other means to extract any web pages or services on the sites, other than the search engine and search tools available from JaxJobs on JaxJobs sites and other than conventional browsers such as Internet Explorer, Chrome, Safari, etc. is also prohibited. Collecting, copying, or duplicating in any way the content or information displayed on JaxJobs, without the express written consent of JaxJobs is prohibited.   All other product and service marks contained on the JaxJobs website are the trademarks of their respective owners.

7. Disclaimer

1. The materials on JaxJobs' web site are provided "as is". JaxJobs makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. Further, JaxJobs does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its Internet web site or otherwise relating to such materials or on any sites linked to this site.
2. The jobs listed on or linked to from JaxJobs may have been authored by people whom JaxJobs has no authority or affiliation. JaxJobs does not screen every job posted and does not accept any responsibility for the content of any job listing or third party website linked to from JaxJobs.com.

8. Limitations

In no event shall JaxJobs or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption,) arising out of the use or inability to use the materials on JaxJobs' Internet site, even if JaxJobs or a JaxJobs authorized representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.

Liability and Warranties: JaxJobs disclaims any and all responsibility or liability for-

• The accuracy, content, completeness, legality, reliability, or operability or availability of information or material displayed on the JaxJobs website whether by JaxJobs, its users or third parties.
• The deletion, failure to store, misdelivery or untimely delivery of any information or material
• Harm resulting from downloading or accessing any information or material on the JaxJobs site or on other sites accessed through JaxJobs.

All materials, information, products and services are provided "as is," with no warranties whatsoever, either expressed or implied. JaxJobs expressly disclaims to the fullest extent permitted by law all expressed, implied, and statutory warranties, including, without limitation, the warranties of merchantability, fitness for a particular purpose, and non-infringement of proprietary rights.

JaxJobs disclaims:

any warranties regarding the security, reliability, timeliness, and performance of the JaxJobs services

any warranties for any information or advice obtained through the services.

any warranties for services or goods received through or advertised on the JaxJobs website or received through any links provided by JaxJobs.

User acknowledges and agrees that data and materials downloaded through JaxJobs is done so at their own discretion and risk. User will be solely responsible for any damages to their computer system or loss of data that results from the download of such material or data.

Some states or other jurisdictions do not allow the exclusion of implied warranties, so the above exclusions may not apply to you. You may also have other rights that vary from state to state and jurisdiction to jurisdiction.

Limitation of Liability: Under no circumstances shall JaxJobs be liable to any user on account of that user's use or misuse of or reliance on JaxJobs arising from any claim relating to these terms of service or the subject matter hereof. Such limitation of liability shall apply to prevent recovery of direct, indirect, incidental, consequential, special, exemplary, and punitive damages whether such claim is based on warranty, contract, tort (including negligence), indemnity, or otherwise, even if JaxJobs or its licensors have been advised of the possibility of such damages and notwithstanding the failure of essential purpose of any remedy. Such limitation of liability shall apply whether the damages arise from use or misuse of and reliance on JaxJobs, from reliance or damage caused by information posted on JaxJobs, from inability to use JaxJobs, or from the interruption, suspension, or termination of any of JaxJobs services or the web site (including such damages incurred by third parties). This limitation shall also apply with respect to damages incurred by reason of other services or goods received through or advertised on JaxJobs or received through any links provided on JaxJobs. This limitation shall also apply, without limitation, to the costs of procurement of substitute goods or services, lost profits, or lost data. Such limitation shall further apply with respect to the performance or non-performance of JaxJobs or any information or merchandise that appears on, or is linked or related in any way to JaxJobs. Without limiting the foregoing, under no circumstances shall JaxJobs be held liable for any delay or failure in performance resulting directly or indirectly from acts of nature, forces, or causes beyond its reasonable control, including, without limitation, Internet failures, computer equipment failures, telecommunication equipment failures, other equipment failures, electrical power failures, strikes, labor disputes, riots, insurrections, civil disturbances, shortages of labor or materials, fires, floods, storms, explosions, acts of God, war, governmental actions, orders of domestic or foreign courts or tribunals, non-performance of third parties, or loss of or fluctuations in heat, light, or air conditioning.

9. Claims of Copyright Infringement

If you believe in good faith that materials hosted by JaxJobs infringe your copyright, the Digital Millennium Copyright Act of 1998 (the "DMCA") provides recourse. You (or your agent) may send us a notice requesting that the material be removed, or access to it blocked. The notice must include the following information: (a) a physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed; (b) identification of the copyrighted work(s) (c) identification of the material that is claimed to be infringing or the subject of infringing activity, and information reasonably sufficient to allow JaxJobs to locate the material on the site; (d) the name, address, telephone number, and email address (if available) of the complaining party; (e) a statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and (f) a statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed. JaxJobs does not, however, make any commitment to update the materials.

11. Links

JaxJobs has not reviewed all of the sites linked to its Internet web site and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by JaxJobs of the site. Use of any such linked web site is at the user's own risk. The site may contain links to other sites on the Internet which are owned and operated by third party vendors and other third parties (the "External Sites"). You acknowledge that JaxJobs is not responsible for the availability of, or the materials located on or through, 

12. Site Terms of Use Modifications

JaxJobs may revise these terms of use for its web site at any time without notice. By using this web site you are agreeing to be bound by the then current version of these Terms and Conditions of Use.

13. Cancellation & Refund.

To receive a refund, contact JaxJobs prior to posting your listing or searching the resume database. No refunds will be issued if a job has been posted or if the resume database has been accessed. User may cancel their account without refund by going online and deleting their profile or by calling 904-737-5627.

14. Governing Law

Any claim relating to JaxJobs' web site shall be governed by the laws of the State of Florida without regard to its conflict of law provisions.

Any action arising out of these Terms of Service and Privacy Policy shall be brought in the state or federal courts located in Duval County Florida and you hereby agree to the jurisdiction of such courts. If for any reason a court of competent jurisdiction finds any provision or portion of the Terms of Service and Privacy Policy to be unenforceable, the remainder of the Terms of Service and Privacy Policy will continue in full force and effect.

These Terms of Service and Privacy Policy constitute the entire agreement between the parties with respect to the subject matter hereof. This agreement supersedes and replaces all prior agreements, written or oral, regarding such subject matter. Any waiver of any provision of the Terms of Service and Privacy Policy will be effective only if in writing and signed by JaxJobs.

By using this site, you signify your assent to this Agreement and agree to comply with all applicable laws and regulations, including U.S. export and re-export control laws and regulations, copyright laws and other laws regarding intellectual property.
